Terms and conditions for using DuttLabs apps.

These Terms of Service ("Terms") govern your use of mobile applications ("Apps") developed and published by DuttLabs ("we," "us," or "our"), operated by Dr. Shankar Dutt. By downloading, installing, or using any of our Apps, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Apps, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Apps.

2. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our Apps for your personal, non-commercial use on devices that you own or control.

You may:

  • Use the Apps for personal purposes
  • Make backup copies for personal use
  • Transfer the Apps to another device you own

You may not:

  • Copy, modify, or distribute the Apps
  • Reverse engineer, decompile, or disassemble the Apps
  • Rent, lease, or lend the Apps to third parties
  • Use the Apps for any illegal purpose
  • Remove any proprietary notices from the Apps

3. App Store Terms

Our Apps are distributed through the Apple App Store. Your use of our Apps is also subject to the App Store Terms of Service. In case of conflict between these Terms and the App Store Terms, the App Store Terms shall prevail to the extent of the conflict.

4. In-App Purchases and Subscriptions

Pricing

Some of our Apps offer in-app purchases or subscriptions. Prices are displayed in the App Store and may vary by region. All prices are subject to change without notice.

Subscriptions

If you purchase a subscription:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your App Store account settings

Free Trials

Some subscriptions may include a free trial. If you do not cancel before the trial ends, you will be charged the subscription price. Unused portions of free trials are forfeited when you purchase a subscription.

Refunds

All purchases are processed by Apple. For refund requests, please contact Apple directly through their Report a Problem page. We do not have the ability to process refunds directly.

5. User Content

Our Apps may allow you to create, store, and manage content ("User Content"). You retain all rights to your User Content. We do not claim ownership of any content you create.

You are solely responsible for:

  • The content you create and store
  • Maintaining backups of your data
  • Ensuring your use complies with applicable laws

6. Intellectual Property

The Apps, including their design, features, and content (excluding User Content), are owned by DuttLabs and protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

7. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS

We do not warrant that:

  • The Apps will meet your requirements
  • The Apps will be uninterrupted, timely, secure, or error-free
  • Any defects will be corrected
  • The Apps are free of viruses or other harmful components

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUTTLABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data
  • Loss of profits
  • Loss of goodwill
  • Service interruption
  • Computer damage or system failure

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Health and Medical Disclaimer

Some of our Apps (such as Hydrate, FastTrack, and MediMinder) provide health-related features. These Apps are intended for informational purposes only and are NOT:

  • Medical devices
  • Substitutes for professional medical advice
  • Intended to diagnose, treat, cure, or prevent any disease

Always consult with a qualified healthcare provider before making any changes to your health routine. If you experience a medical emergency, contact emergency services immediately.

10. Indemnification

You agree to indemnify, defend, and hold harmless DuttLabs and Dr. Shankar Dutt from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Apps
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Termination

We may terminate or suspend your access to our Apps at any time, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

  • Your license to use the Apps is revoked
  • You must delete all copies of the Apps
  • Sections of these Terms that should survive termination will survive

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, through in-app notifications.

Your continued use of the Apps after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Apps shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DuttLabs regarding the use of our Apps.
